It is for these purposes that the law provides for the mandatory conduct of qualification exams with a list of test questions in the form of an interview or examination tickets. But what is the essence of such a procedure? What are its forms, varieties and implementation techniques? You should learn more about all this, as well as about the procedure for conducting a qualification exam with government and civil servants.

Essence

Federal Law of the Russian Federation “On State Civil Service” No. 79 in part of Article 49 “Qualification Examination” outlines the goals, necessity and timing of the relevant checks among citizens holding those positions in state municipal services that require strict and mandatory maintenance of the level of competence of employees. Simply put, we can conclude that this is a kind of targeted audit carried out by executive authorities at different levels in order to identify whether an employee is in compliance or inconsistency with his rank, as well as the possibility of his future career advancement. So, based on the results of such an inspection, the employee either shows a mismatch of the position (fails the exam), or proves his affiliation and justifies the rank assigned to him, or declares the level of his competence sufficient for assigning him another, higher rank and promotion. To this end, the legislative regulation of the compilation of a specific list of questions for the qualification exam in a test, ticketed or interviewed mode.

Who needs to pass this kind of test? In order to answer this question, it is worth mentioning that such exams are intended for two types of employees:

  • Civil municipal servants - employees of executive bodies (constituent entities of the Russian Federation), carrying out professional activities within the framework of obligations stipulated by law, and receiving monetary remuneration (allowance) from the budget of a civil service subject.
  • Civil servants - representatives of the executive authorities, carrying out their activities within the framework of the obligations stipulated by the federal regulations and receiving monetary remuneration (wages) directly from the federal budget funds.

In fact, these concepts are very similar to each other, since identical qualification requirements are put forward for such employees, their positions are classified according to the same hierarchical levels, and the calculation of wages and the provision of social guarantees practically do not differ.

However, there is still a difference: civilian municipal servants belong to the subjects (authorities) of the Russian Federation, legally independent of state structures and not accountable to them. And civil servants, in turn, carry out their activities at the level of federal, regional or local self-government, reporting directly to the state. The concept of civil servants is somewhat broader than the concept of civil servants, since it also includes military personnel. For such employees, a qualification exam with a list of questions on relevant topics is mandatory.

Implementation procedure

The procedure for the qualification examination of civil servants provides for the certification committee to verify knowledge of a particular employee (s) at their initiative or at the request of the employer. If an employee of an organization intends to increase his position, he submits a corresponding application to conduct his exam to confirm the appropriate level of competence. And if the result is positive, the employee is assigned a new rank. If the initiative does not come from an employee, or the deadlines regulated by law have approached, then the employer will initiate a qualification examination of the municipal employee. It is worth mentioning that mandatory inspections are carried out no more than once a year, but no less than once every three years.

For the examination action, a control commission is selected, which includes specialists of the corresponding orientation and independent experts. If the competence of an employee applying for the position of a judge is subject to this verification, the commission shall include judges of general jurisdiction and judges of arbitration courts. If the auditor’s abilities are checked, the commission includes members of the audit collegium. If, for example, a notary is tested, the commission should include lawyers.

Important: only employees who carry out their professional activities on an unlimited basis are subject to qualification checks. If the employee has concluded a fixed-term contract with the employer (an agreement with the agreed deadlines), he is not subject to a qualification exam.

Forms of

The exam itself is carried out in different ways, depending on the form of testing the knowledge and skills of the examinee. The list of questions for the qualification exam varies based on three options for its implementation:

  • Testing - the employee’s written work is performed by him for a period of not more than three hours and is submitted to the members of the commission for verification.
  • Interview - examiners in the face of the commission board ask oral questions to the examiner.
  • Tickets - in the assignment, a specific topic is presented corresponding to the occupied (claimed) position, in which the employee must give a detailed answer.

Important: as a check, only one of the possible forms of the exam is selected, they are not combined with each other.

Varieties

The classification of exams to identify the level of competence of state municipal servants provides for the allocation of two main types of exams: regular and extraordinary.

The next exam is carried out on the basis of the schedule of examinations established in organizations. The mercenary sends an order to the personnel department to select those employees whose terms require mandatory verification.

An extraordinary exam is initiated by the employee himself, who wants to show his abilities, show them to his mercenary in order to further advance up the career ladder and occupy him with a higher position.

A practical exam involves testing a public service employee with certain skills and abilities that he must apply in his work. In this case, the examiner is given practical tasks with elements of a situational nature in order to study and evaluate the way out of the situation using the correct, correct and professionally ethical method.

Professional module

Conducting a qualification exam in a professional module is different in that it is aimed at testing knowledge of vocational education students.
